Saber K9 Liability Waiver

By clicking your consent, in consideration of the services rendered by Saber K9 LLC to my dog(s), I acknowledge reading, understanding, and accepting the statements herein. Please acknowledge the following policy statements by typing or filling out the form at the bottom of this page. If you do not agree to all statements, please do not complete this form, and contact Saber K9 LLC directly for more information.

LIABILITY

I understand certain programs that my dog may participate in, including hikes, obedience training, day school, boarding, protection, scent work, obstacle course, one-on-one play, movement within and outside the facility, and transportation to and from Saber K9 LLC involve risk and possible injury, including but not limited to: Exposure to parasites, viruses, and other medical conditions passed from dog-to-dog or person-to- dog; Sprains, strains, bites, broken bones; Fatigue, dehydration, nicks, cuts, or death.

I further understand that not each and every potential risk can be listed above but, nonetheless agree that the activities associated with dog socialization outweigh the possible risks, therefore, I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify Saber K9 LLC and its agents, successors, heirs, from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my dog’s participation in activities at Saber K9 LLC, including those allegedly attributable to the negligent acts or omissions of Saber K9 LLC.

Further, I understand that I may be exposed to certain risks when bringing my dog to participate in activities at Saber K9 LLC or when picking up my dog and or dropping off from participating in activities at Saber K9 LLC. Such risks may include property damage and/or physical injury inside or outside the facility, such as from falling, slipping, illness, and/ or dog bites. Therefore, I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify Saber K9 LLC, its agents, successors, heirs from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my dog’s participation in activities at Saber K9 LLC, including those allegedly attributable to the negligent acts or omissions of Saber K9 LLC.

Authorization of Medical Care

If my dog is ill or injured while participating in activities at or with Saber K9 LLC, Saber K9 LLC will make every reasonable effort to reach me pursuant to the contact information I have provided Saber K9 LLC. However, if Saber K9 LLC is unable to reach me, I consent to Saber K9 LLC seeking appropriate veterinary care and I accept responsibility for any and all associated expenses. Saber K9 LLC will not pay any portion of veterinary expenses associated with seeking medical care for my dog if so necessary. Allergies, Special Diets, and Medications I agree that I will disclose to Saber K9 LLC any allergies my dog may have. I further agree to disclose to Saber K9 LLC any special dietary needs or medications my dog may require if necessary during activities at Saber K9 LLC.

Cancellation

If a client fails to give at least 24 hours notice cancellation notice, or is not present at the time of scheduled appointment, the client will not be reimbursed the cost of the appointment. For package deals, the session will be counted as one session. If a client is more than 20 minutes late to the appointment, the trainer has the right to refuse the session.

Damage

I accept the responsibility of paying for any damage to facility, property, and/or equipment caused by the dog.

Valid Dates

These agreements, waivers, and authorizations will remain valid and in force as long as and whenever my dog participates in any activity at or with Saber K9 LLC.

Warning

By purchasing this package, acknowledge that if my dog is or I am hurt or property is damaged during my dog’s participation activities at Saber K9 LLC, I may be found, by a court of law, to have waived my right to maintain a lawsuit against Saber K9 LLC on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read and fully understand this entire document and I agree to be legally bound by its terms.

Dog Training Services Agreement

This agreement between the paying client (hereinafter referred to as “Client”) and Saber K9 LLC (hereinafter known as “Trainer”) pertains to the following: The client’s dog (hereinafter referred to as “Dog”) for good and valuable consideration, the parties agree as follows: Training Fees: a. Client agrees to pay Trainer a nonrefundable fee in the amount of $100 for first session and or a package of 5 1:1 sessions in the amount of $600 for OB and $800 for Behavior Modification. All sessions must be completed within 180 days from the date of commencement of contract or they will be forfeited.

Services: Trainer will make every reasonable effort to help Client achieve training and behavior modification goals but makes no guarantee of Dog’s performance or behavior as a result of providing professional animal behavior consultation. Client understands that he/she and members of the household must follow Trainer’s instructions without modification, work with dog daily as recommended, and consistently reinforce training being given to Dog.

Liability: If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses. At Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in Trainer's sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect. This Agreement is binding upon Client, spouse of Client, and children of Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer.
